Abstract

The environment has captured the attention of scholars across various branches of law. This jurisprudential interest has been accompanied by legislative interest, as laws related to protecting the environment from pollution have been issued in many Western and Arab countries. The task of jurisprudence has grown in interpreting and analyzing constitutional and legal texts, extracting missing provisions, and reconciling seemingly contradictory provisions, all within a conscious awareness of the social imperatives that necessitate highlighting this foundation.

In this study, the researcher examines the local Kuwaiti environmental system, which has been affected by the significant developments witnessed by the State of Kuwait in various fields. These developments include the country's increasing need for water desalination and distillation, the significant increase in the number of cars, and the spread of factories across the country. This has the potential to negatively impact the environment. Factory waste and its waste affect the terrestrial environment, and the increase in desalination operations affects groundwater reserves by increasing salinity. The proliferation of cars and their exhaust emissions also impacts the air environment.
