Abstract

            Arabic is a fundamental requirement for developing the capacity for independent legal reasoning (ijtihad) in Islamic jurisprudence (usul al-fiqh), upon which the process of deduction in the principles of Islamic jurisprudence (usul al-fiqh) depends. It is an essential tool that enables the jurist to understand the religious texts (the Quran and Sunnah) and to correctly derive rulings based on the meanings of words and styles. This equips the jurist to keep pace with modern linguistic sciences and to deal with emerging issues. This research paper, "The Impact of the Arabic Language on the Jurisprudent's Capacity," aims to define the concept of language, its importance, characteristics, and status. It then demonstrates how the science of Islamic jurisprudence is derived from Arabic and how scholars of jurisprudence rely on the rules of the Arabic language. Given the importance of research into the capacity of the jurist, the paper clarifies the concept of a jurist and the capacity for independent legal reasoning, the relationship between the jurist and the Arabic language, and the qualities a jurist must possess. It then explains the importance of independent legal reasoning (ijtihad), the conditions for eligibility for it, the impact of language on the principles of jurisprudence in deriving legal rulings, and the reasons for differences among jurists in the meanings of words. The researcher adopted a descriptive-analytical approach, analyzing linguistic texts to extract rulings.  

  The researcher reached the following conclusions:

1. The Arabic language plays a fundamental role and has a close and interconnected relationship with the principles of Islamic jurisprudence (usul al-fiqh) in deriving legal rulings and understanding and discovering scientific facts through contemplation and reflection on the words and their meanings in the Quranic texts.

2. The Arabic language represents the essential foundation for understanding legal texts and deriving rulings from them, and the ability to exercise independent legal reasoning (ijtihad) cannot be fully realized without mastering it to accurately grasp the issues of Islamic law, both in jurisprudence and its principles.

3.It was also found that many of the reasons for jurisprudential differences stem from differences in linguistic meanings, which underscores the necessity of paying attention to linguistic studies in the scholarly training of a qualified jurist.
